最近有不少公司進行裁員,勞工法例上,如果僱員根據連續性合約受僱不少於24個月,並因裁員而遭解僱,僱主需要支付遣散費。

可惜有部份僱主為節省遣散費,會暗示HR及部門主管 “嘗試” 勸僱員自己離職。當然有部份僱員不願屈服,堅持留守至正式裁員,成功領取遣散費。但也有不少僱員選擇自己離職,原因不外乎怕被寫花紀錄、怕不能收到推薦信、怕成位眾矢之的、怕被標籤成搞事分子、怕下一個僱主做背景審查時被抹黑…

僱員作為被迫害者,所受的精神傷害固然無容置疑,而HR、部門主管作為執行者也不是每個都鐵石心腸。當你被迫成為執行者,面對這個殘酷的KPI時,你又會如何自處?

Many companies have recently undergone restructuring and layoffs. Under labor law, if an employee has been employed under a continuous contract for no less than 24 months and is dismissed due to redundancy, the employer is required to pay severance.

Unfortunately, to save on costs, some employers hint that HR and Department Heads should “try” to persuade employees to resign voluntarily. While some employees refuse to back down and hold out until they are formally laid off to secure their severance, many others choose to leave on their own. Their reasons are often rooted in fear: fear of a stained employment record, fear of not receiving a reference letter, fear of becoming a target, fear of being labeled a “troublemaker,” or fear of being badmouthed during future background checks.

As the ones being forced out, the psychological toll on employees is undeniable. However, HR and Department Heads—the executors of these decisions—are not all cold-hearted. When you are forced to be the executor and face this brutal KPI, how do you handle it?
